btw, so how on earth does the barometer works?? i do believe it will not be so clear cut. It'l more likely to be based on many underlying factors. Hence, if in the first place u need a 'barometer' to 'calculate' the percentage of damage to be bonded by either drivers, it jus means: things are not so clear cut and hence you cant exactly say 'wannabe is liable to 10-20%, or lorry will be liable to 90% etc...it all depends. Take tailslide eg..did he pay a single cent??
barometer of liability chart is which all insurance companies endose and to determined what liability ones has in an accident. idac and workshops based on this barometer to advice those involve in an accident.
the Barometer of liability chart will apply in all situations except:
1. when there is independent witness; and/or
2. when there is action taken by the traffic police; and/or
3. when there is a repudiation of liability (based on GIA guideline)
any tailslided vehicles involved in accident, need identifying the area of damage. it could be a 50-50 case, fyi all 50-50% case affects both parties involved in an accident. unless u have ncd protection in your insurance policy.
